At a short meeting, the Harpswell Board of Appeals elected David Z. as chair and chose Steve Music as secretary, and members discussed scheduling and legal representation for a deferred land-use appeal.
David Z. was nominated and seconded for chair and, after brief discussion, accepted the nomination. Speaking after the nomination, David Z. said he had read the 50-page appeal package twice and described the chair role as "technically demanding," adding that he would accept the duties while reviewing whether he could continue in the role beyond a year. He also urged improved communication between the town office, codes office and committee so members receive materials in a timelier way: "it's important that there be a record of that communication" he said.
Members voted to approve the nomination by voice vote; the transcript records that the motion "carries," but it does not record a numerical tally.
The board also nominated and elected Steve Music as secretary. Speakers reminded members that the secretary's responsibilities include preparing the annual report for town meeting and assisting with the notice of decision; town office staff will prepare minutes and the notice in many cases. One member said, "I was the secretary last," while another noted that the town office had a staff member handling committee minutes and related paperwork.
Discussion focused on the upcoming Maramman appeal, which was postponed from this meeting because attorneys could not all attend. Members said they expect the appeal to be heard at 3:00 p.m. on the 15th if counsel can be assembled. The board reported it had engaged a land-use attorney from a firm identified in the meeting as "Isaacson" to represent the board at the appeal.
Several members criticized the seven-day deadline for filing a notice of decision as too short for complex cases. One member said the requirement felt "unreasonable" for lay people asked to prepare and file a technical notice within a week; another suggested asking the town attorney to draft an initial notice of decision for the board to mark up.
The meeting ended after the officers were elected and routine scheduling items were reviewed. Members said the hearing recording and town staff transcriptions would support preparation of the notice of decision and minutes. The board adjourned after a motion to close carried.
What’s next: The Maramman appeal is tentatively scheduled for 3:00 p.m. on the 15th pending confirmation that counsel can attend; the board expects to have its attorney present and to review a draft notice of decision prepared with counsel’s assistance.
