Council schedules Jan. 23 hearing after BZA denies resident’s chicken request

The Village of Enon council on Jan. 4 scheduled an appeal hearing for Jan. 23 after the Board of Zoning Appeals denied a resident’s request related to backyard chickens. Mayor Tim Howard said, “The Board denied her request per our ordinance,” and recommended the council hear the appeal at the next regular meeting at 6 p.m.
The council asked staff to provide copies of the BZA hearing documents, the relevant ordinances, and any other materials that would assist members before the Jan. 23 hearing. Mayor Howard told council members those materials will be delivered as soon as possible.
Under the village’s process explained in the meeting, the council may uphold the BZA decision, reverse it, or reverse with modifications. Howard noted the village has a 45-day window to schedule the appeal hearing; the transcript indicates the decision on the appeal itself does not have to be delivered within that 45-day window.
The scheduled hearing gives council members time to review the BZA materials before the session. The meeting notice, Mayor Howard said, will be posted and adjacent property owners notified. No formal vote on the scheduling of the appeal was recorded in the minutes; the council’s next meeting is the date proposed for the hearing.
