Board awards $588,800 Stryker water-tower repainting; late-bid protest prompts rejection of third bid

Williams County commissioners voted April 23 to accept the Maumee Valley Planning Organization and FellerFinch recommendation to award the Stryker elevated water-tank repainting and control-panel replacement project to L & T Painting for $588,800.
The award followed a public bid-opening and an engineer's recommendation that L & T's $588,800 base bid best met the project requirements and budget expectations. The resolution formalizing the award (Resolution 26-0208) passed by roll call.
The project discussion was followed by a bid-timing dispute. Tom Lingvai of Bryan Excavating addressed the board and objected to consideration of another bid that, in his view, arrived after the advertised opening time because Addendum 2 had set the public bid opening at 10:30 a.m. Lingvai said the later document (Addendum 3) contained a clerical error that listed a different time in a header but did not change the bid-opening time in the body of the addendum. "It is really inappropriate and you really are opening up a whole other can of worms in opening this bid," Lingvai told the commissioners.
County advisor Dennis Miller recommended not opening the contested submission. After discussion about procedural fairness and procurement law, a commissioner moved to follow Miller's recommendation and not accept the late bid; the motion carried on a roll-call vote.
Commissioners agreed that, even if another bidder proved to be lower, rejecting or re-bidding was an available option. The board instructed county staff to follow the prosecutor's office and procurement rules and to ensure public notice and addenda are clearly circulated for future lettings.
Next steps: county staff will complete contract paperwork with L & T Painting and process execution documents. The board also left open the option to re-bid if necessary and instructed the prosecutor's office to advise on any follow-up procurement steps.
