Select Board member Colette Aufranc moved to enter executive session and Thomas Ulfelder seconded the motion; the Board polled 4-0 in favor while one member, Beth Sullivan Woods, was not present for the vote. Chair Marjorie Freiman said the chair had determined that discussing the matter in open session would be detrimental to the Town’s position and invited Executive Director Meghan Jop, Assistant Executive Director Corey Testa, Town Counsel Thomas Harrington and Eric Reustle, and Special Counsel Nicholas Shapiro to join the executive session.
Under Massachusetts law cited in the motion, M.G.L. c. 30A §21A Exemption #3 permits public bodies to enter executive session to discuss strategy in pending or potential litigation. The Board returned to open session at 6:11 p.m., voting 5-0 to resume public business.
