Board adopts age-restricted residential overlay ordinance with one abstention

Upper Hanover Township’s Board of Supervisors held a public hearing and adopted Ordinance No. 2022-01 on May 10, establishing an ARR Age-Restricted Residential Overlay District and adding a new Article XXIII to the zoning ordinance.
Solicitor Joseph Bresnan opened the hearing, and applicant representatives included Bernadette Kearney and engineer Cynthia Smith of Horizon Engineers. Testimony addressed the overlay boundaries (Montgomery County tax parcels listed as Attachment A) and development requirements; a resident (Kevin Fox) asked whether the plan obligates a street connection to Washington Street. The plan provides for an emergency egress only, the applicant said.
After testimony and public comment, Supervisor Dorothy Diehl moved to adopt the ordinance and the motion passed 4-0-1; Chairman Steven R. Rothenberger abstained from the vote because of a possible appearance of a conflict of interest. The ordinance adds standards for use, area, bulk and development requirements for age-restricted residential development in the identified parcels.
The adoption was recorded in the meeting minutes and the new overlay is now part of the township zoning code; further permitting and site-specific approvals will remain subject to the township’s subdivision and land development and building permit processes.
