Council delays change to allow apartments above commercial space in Ordinance 2025-07

During a discussion of Ordinance 2025-07 at the Sept. 24 work session, Councilman Ellis proposed amending item 28 to change the status of apartments above or below commercial spaces from “not permitted” to a “conditional use.” The change would allow such residential uses only if specific conditions are met.
Councilman Merrill expressed concern about moving the amendment forward without adequate due diligence, warning that parking, safety and infrastructure implications need further review. Merrill said she preferred to pass the ordinance’s Bitcoin-related provisions first and consider the apartment change separately.
Mayor Rok said she would incorporate input from the Planning Commission on conditional-use criteria — including traffic, noise, lighting and hours of operation — and prepare a second-reading version for the Oct. 14 meeting. No vote was taken on the apartment provision at the work session.
