Council denies rear-yard setback variance tied to Fahe Management lot split

Councilmembers voted unanimously on Nov. 12 to deny a requested 29.6-foot rear-yard building setback variance from the 45-foot requirement for a lot consolidation and split involving permanent parcel numbers 41-00812, 41-00813 and 41-00814, filed by Fahe Management Inc.
Planning Commission review on Oct. 15 did not approve the substantial rear-yard setback variance needed for the lot split; Engineer Daniel Collins noted correspondence from a neighbor indicating no objection, and resident Patty Morelo told the Commission she had no issue with the proposal. Despite those statements, Councilmember Alan Hipps moved to deny the variance, Councilmember Renell Noack seconded, and Council adopted the denial by roll call vote.
The denial means the lot consolidation and split cannot proceed as proposed without a successful variance or a revised plan that meets zoning requirements; the matter may return if applicants submit a modified request.
