Board continues show-cause hearing for 411 Upper County Road after tenant blocks interior access

At the show-cause hearing for alleged noncompliance at 411 Upper County Road, attorney Paul Revere (representing the Carl Anderson KBS Realty Trust) told the board that a joint inspection on Oct. 30 led to building-department corrections and that some exterior repairs were completed. Revere said his client has been unable to perform interior work because the tenant repeatedly refused entry despite 72-hour notices.
"The tenant will never let my clients' people in to paint the place," Revere said, describing multiple aborted attempts to access the unit. Revere told the board the matter was taken to housing court and that a hearing and mediation were scheduled; he asked the board to await the court outcome.
Health staff confirmed issuance of a certificate of compliance for upgraded septic work and said they have not been able to reinspect for full compliance because they cannot enter the dwelling. A committee member moved that the board continue the show-cause hearing to next month to receive an update after the housing-court hearing. The board voted unanimously to continue the matter and requested the owner report back on the outcome of the court proceeding and any progress on access and repairs.
What happens next: The owner and attorney will attend housing-court mediation; the board will revisit the show-cause matter next month based on the court outcome and any completed work or access to the dwelling.
