Mayor Dave Nickerson read a formal declaration at the Jan. 20 meeting that a vacancy exists on the New Lebanon Village Council following the disqualification of newly elected council member Keith Moody.
Nickerson cited the New Lebanon charter provisions that govern vacancies and said the council must appoint a qualified elector by majority vote within 30 days of the vacancy. Interested qualified electors must notify the clerk of council in writing by Jan. 28 to be considered for appointment.
Council briefly discussed whether to hold a special meeting to interview applicants. After council input, members agreed not to schedule a separate special meeting and to consider applications at the council’s first meeting in February. The clerk will notify applicants in writing of the date, time and place for the special meeting if one becomes necessary.
The declaration established a timeline and listed the statutory qualifications for appointees: continuous residency for at least one year prior to consideration, being a qualified elector of the municipality, being in good standing on municipal income taxes and not being an employee of the municipality.
The council did not take a formal vote on the vacancy declaration beyond reading the charter-based notice; procedural steps for applications and final appointment were assigned to the clerk of council.
