New Lebanon council approves $70,000 settlement in suit by Curtis Hensley

The New Lebanon Village Council voted unanimously on Dec. 2 to approve Resolution 2025-40, authorizing a mutual settlement and indemnity agreement to resolve a lawsuit filed by Curtis Hensley. The law director explained the agreement and told council the total settlement figure is $70,000.
"Curtis Hensley filed suit against the city," the law director said, adding that the settlement "expressed to states that there's no admission of any liability." He said the insurance carrier exercised its right to pay the amount to have the suit dropped. After discussion the council approved the resolution by a 7–0 recorded vote.
The law director also clarified after the vote that the $70,000 payment will come from the insurance company's funds and not from village coffers. He said several council members had been named in the suit in their personal capacities and that his personal case had been resolved through a separate summary judgment motion prior to the settlement negotiations.
The resolution authorizes execution of the settlement and an indemnity agreement; council did not discuss additional financial mechanics or release language beyond the law director’s summary during the meeting. The council will record the settlement in official minutes and move to finalize execution as provided in the resolution.
