Garfield 16 board tables nondiscrimination and harassment policies pending legal review

At its Aug. 13 meeting, the Garfield County School District No. 16 Board of Directors attempted, but failed, to adopt a set of nondiscrimination and harassment policies on second reading.
President Vincent T. Tomasulo moved to approve the policies — which included AC (Nondiscrimination/Equal Opportunity), several AC-R investigative procedures, GBAA (Sex-Based Harassment), and JBB (Sex-Based Harassment) — but the motion received no second and was recorded as failed.
Board member Samuel W. Stewart then moved, with Kimberly S. Whelan seconding, to table the listed policies and directed Superintendent Dr. Jennifer A. Baugh to obtain a legal opinion from district counsel before bringing revised language back to the board. The tabling motion passed on roll call: Brent Baker—aye, Keith Gronewoller—absent, Samuel W. Stewart—aye, Vincent T. Tomasulo—aye, Kimberly S. Whelan—aye.
The board did not adopt final language at this meeting. Dr. Baugh told the board the district will seek counsel and may present revised policy language at a future meeting; a revised set of policy documents may appear in the Sept. 10 packet. The board recorded the tabling as an official action rather than final approval.
Next steps: the item will remain tabled until the superintendent reports back with legal guidance and any recommended revisions.
