Select Board reviews notice-of-violation updates, schedules court dates for problem properties

Town staff reviewed progress on multiple property code-enforcement matters and alerted the Select Board to upcoming court dates.
Staff said a notice of violation (NOV) is in place for 277 Mountain Road and a court hearing to seek removal of the building is scheduled for July 6. A separate matter at 8:30 Denmark Road is now in bank foreclosure; staff confirmed an August 3 pre-trial hearing after the bank initiated foreclosure and said the town had sent NOV notices to the owner, the bank and the bank’s attorney.
The barn structure at 949 Denmark Road remains subject to an earlier NOV with a compliance deadline in late May/early June; staff will forward that file to the town attorney for court work if the owner does not meet the deadline. Two junkyards on West Main will receive NOVs this week; staff noted the attorney can pursue multi-property cleanups to accelerate enforcement when appropriate.
Board members discussed how many cases to bring to court at once and agreed sequencing should consider case type (junkyard vs. dangerous structure) and the town attorney’s capacity. Staff said they will send an updated enforcement file to board members when Lindsay finishes the current site visits and documentation.
"We'll ask the court for them to remove the building," staff said of 277 Mountain Road, and confirmed that if the town pays contractors to complete work, it will seek reimbursement via court judgment and, if necessary, by placing a supplemental tax bill.
