Town engineer issues notice of violation after Ponside residents report erosion at BrightView site

Supervisor Paul Feiner said town staff and the town engineer, Jason Coppola, inspected the BrightView assisted-living construction site after multiple residents in Ponside reported erosion and property damage and issued a notice of violation citing sediment runoff and deficiencies observed on March 16, 2026. He said the town sent the notice to the project owner last night and that staff returned to the site this morning to prepare a second report for the board.
The inspection and notice list corrective actions already taken and additional required measures: placement of tarps over an unused construction entrance, reinstallation of silt fencing along a sidewalk, ordering hay bales, check dams and inlet protection, covering soil with erosion-control blankets and seeding, and replacing catch-basin inlet fabric with proper inlet protection. Feiner said the town engineer will finalize and forward the reports to the board when they are complete.
Residents told the board they wanted a clear plan and enforceable steps. A resident said she did not want people to take time off work to attend a meeting only to be told staff could not provide concrete answers: "Having people come here to say, we don't really know what to tell you is not helpful to anybody," (Resident (S5)). Board members recommended that staff follow up with the engineer and the contractor, and several members suggested Jason Coppola attend the next work session to answer technical questions.
Feiner said residents plan to attend the regular town board meeting next Wednesday and asked staff to provide a status update at that time; members agreed to place a status update on next week's work-session agenda so the town can report what enforcement steps and remediation are under way. The board did not enact a stop-work order in the session; Feiner said stop-work authority and enforcement actions rest with the building department and engineering staff and must follow the town's legal process.
The town cited concerns both about property damage and potential violations of the town's permit conditions with the state related to stormwater control; staff will report further details and any proposed enforcement actions as the follow-up inspection report is completed.
