The Beachwood Planning & Zoning Commission voted Oct. 30 to grant a 4-foot rear-setback variance that will allow a 10-by-14 foot shed to be placed 6 feet from the rear line at 23250 Halberton Road.
Applicant Sean Starks told the commission the lot’s pie shape and corner status make the standard 10-foot rear setback impractical. "Because of the pie shape ... I feel there's a hardship here and I recommend approval," a commission member said during staff discussion of the lot configuration.
City staff and commissioners agreed the lot geometry created a practical difficulty under the zoning code and recommended approval subject to the stipulations in the staff report. The commission moved and seconded a motion finding practical difficulty and granting a variance to permit the accessory building at 6 feet from the rear line instead of the code-required 10 feet.
The motion passed. Staff noted that, because the lot is considered a corner lot under the code, the standard rear setback would place a shed centrally in the yard and that allowing the variance accommodates reasonable placement without undermining adjacent standards.
The commission recorded the decision and closed discussion on the item.
