Cabell County Commission approves budget revisions, hires data technician and refers probate matters

CABELL COUNTY — The Cabell County Commission on June 9 unanimously approved a slate of budget revisions, personnel actions and administrative resolutions and addressed multiple probate matters, then met in executive session on litigation.
Anne Yon, president of the Cabell County Commission, called the meeting to order at 10:00 a.m. and said the agenda needed to be amended to add an emergency executive session to discuss litigation; Commissioner Robert L. Bailey moved to amend the agenda and Commissioner Nancy Cartmill seconded. The motion passed unanimously.
The commission approved routine items including purchase orders #16-72383 through #16-72690 and associated pay jackets, erroneous assessments, land consolidations, split tickets and probate documentation. Commissioners also authorized handwritten checks to Guardian, Mutual of Omaha and HMBCBS not to exceed $100,000 and approved ACH drafts for weekly claims experience/administration cost (EBSO and HMBCBS); those motions were moved by Commissioner Robert L. Bailey, seconded by Commissioner Nancy Cartmill and carried unanimously.
County Attorney William Watson recommended denying a claim against the estate of Willa Mae Massie; Commissioner Cartmill moved to deny the claim, Bailey seconded, and the vote was unanimous.
During the public-comment portion, Gail Ruth Glenn told the commission that a hearing to remove the personal representative for the estate of Anna Ruth Glenn had been scheduled for that day but was not listed on the agenda and that mailed notice had been provided to interested parties. Watson asked Budget Financial Analyst April Tooley to contact Probate Supervisor Richard Hurley to confirm that documentation had been mailed; President Yon said the matter would be revisited after confirmation.
Watson recommended referring the estate of Dr. Ernesto Nieto to a fiduciary commissioner; Commissioner Bailey moved to make the referral, Cartmill seconded, and the vote was unanimous. Watson also recommended the removal of the current personal representative for the estate of Anna Ruth Glenn and the appointment of Gail Ruth Glenn as substitute fiduciary; Commissioners approved the removal and appointment by unanimous vote.
On fiscal items, the commission approved Special Funds Budget Revision #2 (Fund 26, FY2015/2016), the FY2014–2015 carryover for Fund 9044 (JAG grant), Special Funds Budget Revision #1 for Fund 9044 (FY2014/2015), County Budget Revision #17 and State Budget Revision #8. Commissioners also approved Budget Revision #5 for Cabell County Emergency Medical Services for FY2015/2016.
Commissioner Bailey moved to renew workers' compensation coverage with Brickstreet Insurance; Commissioner Cartmill seconded and the motion passed unanimously.
The commission approved a resolution amending procedures for issuing handwritten checks and for ACH payments applicable to the county's self‑insured insurance process. The board also approved employment of Clayton Bates as a full‑time data processing technician, effective June 9, 2016, at an annual salary of $28,000.
Commissioners voted to adopt an amendment to the Region II Planning and Development Council Hazard Mitigation Plan and placed on record operating budgets for Culloden and Salt Rock Public Service Districts and environmental health/threat preparedness reports from the Cabell Huntington Health Department.
Commissioner Bailey said the county had received a letter from West Virginia Secretary of State Natalie Tennant stating that Cabell County was not found in violation in the previously filed election-law complaint. Bailey also welcomed Delegate Jim Morgan to the meeting.
Commissioner Bailey moved to enter executive session at 10:41 a.m. to discuss litigation; the commission returned from executive session at 11:23 a.m. with no action taken and then adjourned. The commission did not take any final action in open session related to pending litigation.
