Porter staff reports MS4 enforcement actions, Easton Park corrective plan; board approves $1,000 fishing-derby donation

Town staff briefed the Porter Town Board on MS4 (municipal separate storm sewer system) program activity and enforcement at the board’s meeting. Staff said the town issued three fines and two warnings last month for erosion and sediment-control violations and has submitted the 2024 and 2025 annual MS4 reports to the Indiana Department of Environmental Management (IDEM).
Staff named several specific enforcement actions: Sand Creek Phase 5B lot 95 received warnings and a $200 fine for inadequate erosion perimeter control; Easton Park received at least one fine (staff cited $100); a concrete washout at 960 Monterey resulted in a $100 fine; and a sediment-laden discharge on Magnolia Lane drew a $250 fine. Staff said the violators are engaging with the town and working toward compliance.
The board heard a fuller briefing on Easton Park, where staff said developer ATG completed mass grading for an undeveloped future phase and sediment washed onto an existing property (lot 244), reaching a pool. ATG is preparing a seeding plan and proposing berms and additional storm sewer in the undeveloped phase; staff said corrective work was slated to begin immediately to limit further discharge. Staff noted Easton Park had been issued a fine and the developer will submit a corrective schedule.
As part of the MS4 program outreach, the board approved a motion to donate $1,000 to the town’s Porter's Fishing Derby; the motion was moved, seconded and passed by voice vote.
“We issued three fines and two warnings for erosion control sediment violations last month,” staff said. The report also said staff will proceed with outfall and BMP inspections starting in July and continue tracking construction complaints in the town’s BMP tracker spreadsheet.
