Commission tables Bluegrass River Ranch vacate/replat after missing recreation area on plat

Chairman Dave Pellatz called the Converse County Planning & Zoning Commission to consider the Pestotnik Minor Subdivision vacate and replat of lots 6A and 6B in the Bluegrass River Ranch at its May 19, 2026 meeting. The commission heard that the preliminary plat omitted the subdivision’s designated Recreation Area and contained errors in Note 12 and the vicinity map.
Special Projects Coordinator Tory Walsh and commissioners reviewed proposed technical corrections. The board requested Note 12 be revised to read: “THE OWNER HEREBY GRANTS TO ROBERT SCHLIDT, SUCCESSOR TO BRUBAKER RANCHES, INC., ORIGINAL APPROPRIATOR OF THE BRUBAKER PIPELINE DITCH, AN IRRIGATION EASEMENT TO ACCESS, LOCATE, CONSTRUCT, USE AND MAINTAIN IRRIGATION DITCHES AND PIPES, ANY OR ALL OF THEM, UNDER AND ALONG THE AREA MARKED ‘IRRIGATION DITCH EASEMENT’ AS SHOWN.” Commissioners emphasized the Recreation Area must be denoted on the plat and vicinity map.
Commissioner Dustin Ailport moved to table the vacate and replat application pending those corrections; Commissioner Jody Glenn seconded. The motion carried on a unanimous vote. The commission scheduled reconsideration for the next regularly scheduled Planning and Zoning meeting on June 16, 2026.
The discussion centered on plat conformity with current Subdivision Regulations and ensuring all required elements and ownership signatories are shown on the final plat. No written public comments for or against the application were reported at the meeting.
