Germantown board approves routine alcohol licenses, denies separate Shell renewal and directs attorney to pursue non-renewal for Mateo's over unpaid taxes

Germantown, Wis. — The Germantown Village Board on Monday approved routine alcohol license renewals and successor-agent appointments but declined to separately approve one renewal and moved to have the village attorney start a non-renewal process for one restaurant that the clerk said still had delinquent real-estate taxes.

The board voted to approve a temporary Class B beer permit for a Germantown Area Chamber of Commerce event set for July 15, 2026, and confirmed successor agents for two Speedway locations. It also approved the bulk of 2026–2027 alcohol beverage license renewals after police confirmed no objections.

The meeting turned contentious during discussion of two delinquent-license renewal applications. Christy Peper, a trustee, argued Mateo's should be considered separately because she believed the business leased its space and should not automatically be held liable for unpaid property taxes by an owner. "Mateo's is a great restaurant. It was a great addition to Germantown," Peper said in defense of the business.

Donna, the village clerk, responded that under the village’s municipal code and state statute a license cannot be issued for a location that has certain outstanding obligations. She told the board a wholesaler invoice of $948 had been paid but that, "we cannot grant them a license come July 1st until these amounts have been paid," saying in the meeting that real-estate taxes for January remained unpaid as of the date of the meeting.

Staff read a recommendation directing the village attorney to commence a non-renewal process for the combination class B retail alcohol beverage license for Mateo's AC because of delinquent real-estate taxes. Trustees discussed options including approving licenses contingent on payment, holding a special meeting, or directing the attorney to proceed; the board voted in favor of directing the village attorney to proceed with the non-renewal process.

The board also considered an amendment to take the Holy Hill Road Shell renewal separately and to approve it. That amendment failed in a voice vote; the record reflects the board did not adopt the separate approval for the Shell location.

Trustee Pieper asked staff to confirm ownership records; staff provided the tax key GTNV 262965006 and reported the owner listed as NAC Enterprise 1 LLC. Meeting participants later reported finding administrative-dissolution notices for that LLC (notice dated Jan. 14, 2025, and dissolution processed March 16, 2025), and at one point participants said the property appeared to have been transferred to Mateo's as of March 16, 2025. Staff emphasized that the clerk’s office cannot issue a license for a location that is delinquent on real-estate taxes and that the non-renewal process would formally notify the owner and applicant and give them a deadline to cure the arrears.

The board announced its next meeting for Monday, July 6 at 6:00 p.m. and adjourned.
