The East Rockhill Township Board of Supervisors on Aug. 27, 2019 approved a Declaration of Easement for 1211 West Rock Road (tax map parcel 12-009-103-001) that authorizes Township work outside the public right-of-way. The motion was moved by David Nyman, seconded by Jim Nietupski, and passed with two votes in favor and one abstention from Chair Gary Volovnik.
Solicitor John Rice presented the easement instrument during the solicitor’s report. The motion as recorded states the easement will allow Township work outside the right-of-way; the minutes note the motion passed 2-0 with Mr. Volovnik abstaining. No additional discussion was recorded in the minutes.
The minutes show the parcel owner listed as Gary and Amy Volovnik Jr. and identify the parcel by tax map number. The Board did not record further public deliberation in the meeting minutes. Staff and the solicitor are responsible for executing and recording the easement instrument and filing it with the appropriate county offices if required.
Next steps: The Township Solicitor and staff will execute and record the Declaration of Easement as authorized by the Board; the minutes indicate the recording step as a follow-up action.
