The Board of Adjustment approved a variance allowing a rear‑yard pergola at 509 C Myrtle Loop to encroach into the rear setback on a unanimous roll‑call vote.
Staff reported the property is zoned R2S and that the required rear setback is 20 feet; the applicant sought permission to place a roughly 19‑by‑13.5‑foot pergola approximately 9.5 feet from the rear property line. Staff said there were no outstanding items in the report and no calls or letters of objection.
Applicant Alicia told the commission the pergola would attach to the existing porch and would expand outdoor living space. “Behind our home is a private road so I will not be impeding into somebody's backyard,” Alicia said, asking the commission to grant the variance.
Commissioners asked whether there were any utility or drainage easements that would be affected; staff and the applicant said there were none known and confirmed the pergola will be physically attached to the primary structure rather than built as a detached accessory building.
Committee member Prader moved to approve the variance; Committee member Awen seconded the motion, and a roll‑call vote was unanimously recorded in favor. The variance was granted and the Board of Adjustment closed its public hearing and returned the meeting to the Planning Commission agenda.
The action approves the encroachment only; any building permits or inspections required for construction remain subject to standard building and permitting review.
