Commissioners resend tobacco-retail-enforcement resolution after procedural error

The Josephine County Board of Commissioners voted unanimously June 16 to resend and replace a previously passed resolution on tobacco retail enforcement after a board member said the prior vote had not followed correct procedure.
A commissioner opened discussion by saying they had not realized they were prohibited from voting on an item in "other business" and took responsibility for the procedural mistake involving resolution 2026-009. The board considered a revised resolution prepared by the prevention department; legal counsel (Wally) reviewed the revised language and reported no conflicts with state enforceable grants.
The board emphasized that the measure addresses enforcement of tobacco retail licensing—not prevention programming—and that the revised resolution preserves the board’s overall intent while correcting the procedural error. One commissioner noted letters received from the American Cancer Society and Campaign for Tobacco-Free Kids and voiced support for programs aimed at keeping children away from tobacco, while also stressing the board’s desire to respect adult choice and the regulated marketplace.
Commissioner Richardson moved to resend resolution 2026-009 and replace it with revised resolution 2026-027; the motion was seconded, put to a roll-call vote and passed 3–0.
Staff said the revised resolution was submitted last week and will replace the earlier version in the record. The item will be on the business-session agenda for further public comment and final formal action where appropriate.
