Chelmsford Conservation Commission: Waiver for lakeside patio, Russell Mill trail and Heart Pond ADA access approved

The Chelmsford Conservation Commission on March 24 approved several permit actions that commissioners said balance resource protection with community access and maintenance needs.
A request to place a patio and gas fire pit within the 30-foot no-impervious setback at 28 Sixth Lane was approved after the applicant agreed to plan notes and as-built documentation. William Vines moved approval, Peter Spawn seconded, and the motion carried unanimously, 5-0. The record includes a requirement that the plan note the patio pitch of one-quarter inch per foot and that an as-built plan be submitted; commissioners also sought additional planting mitigation and a profile plan for the patio.
The commission also approved a proposal from the New England Mountain Bike Association (NEMBA) to realign the green birdhouse loop at Russell Mill to separate faster bicyclists from hikers. Peter Spawn moved to approve the plan, William Vines seconded, and the commission approved the project with a follow-up email to confirm trail width and excavation limits; the vote recorded was unanimous, 6-0.
Town staff presented a Request for Determination of Applicability for routine culvert replacements and stream clearing at multiple locations; the work, described as matching a 2023 scope, will replace corrugated metal culverts with PVC, repair headwalls and remove accumulated debris within 50 feet of culverts. Commissioners voted to close the hearing and to issue Negative 2 and Negative 3 determinations with the same conditions as the prior approval and with a note that heavy machinery will not be used off pavement. Alexandra Hayden moved approval; the motion passed unanimously, 5-0.
The commission also considered a Notice of Intent to add ADA access between the Bruce Freeman Rail Trail and Heart Pond (5 Pond Street). Town Engineer Tony Reppucci said the project will add accessible matting, ramps and drainage improvements, install two deep-sump catch basins to address high groundwater, and reduce impervious area by 37 linear feet from current conditions. The Chelmsford Land Conservation Trust, holder of the conservation restriction for the property, approved the work. Commissioners closed the hearing and voted to issue an Order of Conditions with standard conditions; the motion carried, 5-0. Reppucci said contractors expect to complete work by June 30, 2026.
A separate Notice of Intent for New England Power Company at 100 Equador Road was continued to April 14 to allow the applicant to respond to recent peer-review comments.
The commission approved meeting minutes for January 27, 2026, and adjourned at 8:57 p.m.
