Council declares emergency to appropriate parcels for SR‑835 bike/ped project to protect federal funding

Kettering City Council on March 10 approved two emergency ordinances authorizing appropriation of private parcels needed for construction of a pedestrian and bike path along State Route 835 (Research Boulevard) in the Miami Valley Research Park.
Engineering staff told council the right-of-way acquisition consultant remains in communication with the property owner but that slow progress threatens the project schedule and could jeopardize federal construction funding. To avoid that outcome, staff recommended proceeding with appropriation for parcel 10 (fair market estimate $10,284) and a separate appropriation for parcels 12-WD1, 12-WD2, 12-WD3 and 12‑T (total estimated $55,450). “That slow progress threatens the project schedule. Therefore, the city staff is recommending proceeding with the process of appropriating the needed rightway from parcels 10 and 12… as needed to keep the project on schedule and not jeopardize federal funding for construction,” staff said in the presentation.
Council declared both ordinances emergency measures so they would be effective immediately upon adoption and voted unanimously to approve both appropriations. Staff said the acquisitions are required for construction of the segment of the SR‑835/Research Boulevard bike‑ped path between Founders Drive and Little Beaver Creek and that the fair market estimates are on file.
Council directed staff to proceed with appropriation proceedings and to keep council informed of schedule and funding implications as rights acquisitions progress.
