An accessory building that was partially erected at 12200 Lyndway Dr. received a planning variance on June 17 after the owner, Anthony LaPorta, said he and the contractor paused work when told a permit was required.
LaPorta told the board he had mistakenly believed property markers were for an invisible pet fence and did not realize the structure would be too close to the property line. Building Commissioner Larry Ellis said he encountered the installation crew and required them to stop and submit a Building Permit application and liability insurance; Ellis also confirmed he sent a notice to a neighbor and received no objection.
The board approved a 5 feet 6-inch variance from the east property line (Ordinance Section 1248.05(b)). Member Joseph White moved for approval; the motion passed unanimously (Aye — White, Bertovich, March).
Mayor March encouraged the owner to consult a contractor familiar with local permitting for future projects. The variance allows the owner to regularize the structure subject to standard permitting and inspections.
