East Rockhill Township Zoning Hearing Board grants Perkasie Regional Authority setback variances for Park Avenue booster station

The East Rockhill Township Zoning Hearing Board voted unanimously July 22 to grant variances to the Perkasie Regional Authority so it may install a booster station at 1503 Park Avenue in the R-1 Residential district.
Chairperson David Chlebda moved to grant the relief; the motion was seconded by Alternate Member John Fenley and carried by all members present. The Board’s action approves reduced yard setbacks and waives certain buffer requirements described in the township zoning code, subject to conditions including a six-foot-high fence or evergreen plantings at the Township Engineer’s discretion and the applicant’s securing Conditional Use and Land Development approval.
The applicant requested four variances from the East Rockhill Township Zoning Ordinance. The Board record cites relief from Section 802.b for yard setbacks, Section 1901.a(1) for the minimum building envelope, and Sections 1905.a and 1905.b for Class C buffer width/plantings and the prohibition on structures within the buffer yard. Kevin Wolf of Anderson Engineering provided testimony on the proposal; Mark Eastburn, Esq., appeared as counsel for the Perkasie Regional Authority. The application identifies the property as Tax Map Parcel 12-008-100-003.
During the hearing the requested setbacks were clarified: the front yard setback was stated as 61.4 feet where 75 feet is required, the rear yard setback as 24.7 feet where 75 feet is required, and a side yard setback of 28 feet where 40 feet is required. The record further notes the ordinance’s 20,000-square-foot minimum building-envelope requirement and the 40-foot Class C buffer standard with plantings that the Board granted relief from.
No members of the public requested party status for the case. After discussion, the Board’s motion included explicit conditions that the applicant comply with all exhibits and testimony, receive Conditional Use and Land Development approval, and accept the Township Engineer’s decision regarding fencing or plantings. Zoning Hearing Solicitor Scott MacNair was directed to prepare the Board’s Conclusion of Law as the official document reflecting the decision.
The Board also approved the February 25, 2019 meeting notes with no changes, heard no other business, and adjourned at 8:18 p.m.
