Richard E. Pierson Materials Corp. asked the East Rockhill Township Zoning Hearing Board on Jan. 30 to overturn a zoning officer's denial and to allow extractive operations and an asphalt plant at 2055 North Rockhill Road.
The company appealed the zoning officer's determinations that the use requires a special exception and must comply with buffer and development/performance standards; that it must meet requirements for sewage disposal, industrial waste disposal, water supply and storm drainage; and that it fails to meet requirements concerning noise, air pollution, smoke, fumes, water pollution, fire hazards and other safety hazards. The applicant also appealed a March 23, 2018 Notice of Violation asserting that an asphalt plant on the property violates or will violate the zoning ordinance and requires relief and land-development approval.
At the hearing, the board heard testimony from Daniel Humes, P.E., identified in the record as a civic engineer, and from Slavic Mokienko, vice president of R.E. Pierson Materials Corp. The record indicates both witnesses had testimony that will continue at a future hearing; Mr. Humes was noted as having a prior commitment and Mr. Mokienko's testimony was continued to the next scheduled meeting. The board did not make a final determination on the appeals during the Jan. 30 session.
The property at issue is identified in the record as Tax Map Parcel Number 12-009-102-000 and is located in the E (Extraction) zoning district. The applicant requested, as an alternative, special-exception relief to permit an asphalt plant as an accessory use to an H12 Extractive Operation, and asked for any additional relief required to operate an asphalt plant accessory to that use.
