Fairview Park committee opens line-by-line review of council rules; asks law director for multiple clarifications

The Local Government & Community Services committee convened on April 27 to begin a detailed review of Fairview Park Codified Ordinances 111.03 (Council rules). Councilwoman Sarah Waring said the committee will proceed line-by-line and brought forward several items for immediate action and further legal review.
Committee members debated whether to allow public comment during committee meetings. Waring framed two options — adopt a rule that committee meetings do not accept public comment, or add a limited public-comment slot tied to committee topics (either before or after discussion). Councilwoman Sarah Mann argued for permitting comment before discussion so members can hear constituents’ concerns in time to consider them: “I would suggest instead to allow comment before we have our discussion,” she said. Law Director Dever explained that Ohio Revised Code §121.22 requires notice and public access for committee-of-the-whole meetings but does not oblige a public-comment period; he said opening comment can be left to a chair’s discretion.
Recognizing ambiguity in current language, the committee voted 7–0 to ask the law director to rewrite the paragraph that begins "persons including members of council...desiring to be heard by any committee of council shall be given an opportunity to be heard thereat" to clarify whether and how public comment will be permitted in committee.
Other actions taken or requested:
- The committee voted 7–0 to update the definition of "legal holiday" to align with City of Fairview Park–recognized holidays, and asked the law director to review the change.
- The committee voted 7–0 to change agenda wording from “moment of silent prayer” to “moment of silent reflection.”
- The committee voted 7–0 to strike a sentence that required a person to notify the committee before taping a meeting, reflecting current open-meeting and recording practices.
- Members discussed attendance and the phrase "for cause" when excusing absences; Dever advised the council has discretion to judge reasonable excuse on a case-by-case basis and noted charter removal procedures apply after three consecutive unexcused legislative absences.
- The committee asked the law director to review overlapping committee jurisdictions in rules 14 and 54, evaluate the consequences of removing a provision that allows the president to remove a member from a committee, and clarify the meaning and procedure tied to rule 17’s “automatic discharge” after the 18th regular meeting; each of those requests passed 7–0.
- The committee tabled further changes to rule 15 (committee reports and attendance) for further consideration.
Committee members agreed to return Codified Ordinances 111.03 to committee for continued work and legal drafting before bringing revised language back to the council.
