Staff reports: AB-2137 dies, SB-966 advances; hearing-rulemaking moves forward

At its June 3 meeting, the California Occupational Safety and Health Appeals Board received staff updates on pending legislation and rulemaking that could affect the board’s work.
Karen Halbo, staff counsel, reported that AB-2137 did not move to the other legislative house by the May 29 deadline and therefore is dead, while other bills the board is monitoring advanced before the deadline. Halbo also briefed the board on SB-966 (Gonzalez), which would codify elements of process safety management standards with implications for refineries, and noted a federal bill, HR-5437, had been introduced regarding civil actions against manufacturers and sellers of stone slab products.
On rulemaking, Halbo told members that both the Appeal Initiation Regulations and the Prehearing and Hearing Regulations are under Agency review. The Hearing and Prehearing Regulations package is proceeding more quickly through the review process and is likely to be signed first; staff recommended staggering publication so both packages are not issued for the 45-day public comment period at the same time.
Aaron Jackson, Chief Counsel, separately asked to add discussion about the length of hearings to the next public meeting agenda, signaling board interest in procedural review. No board action on the legislative items or regulatory packages was taken at the June 3 meeting; the updates were provided for the board’s information and ongoing review.
