Committee recommends ADU zoning changes to comply with state law, removes minimum lot-size rule

The recommending committee recommended approval of ordinance changes that would bring Las Vegas zoning code into conformity with Assembly Bill 396 (2025), city staff said.
Peter Loenstein, a city planner, told the committee the changes permit accessory dwelling units (ADUs) in all residential zoning districts, remove a prior minimum lot-size requirement (previously 6,500 square feet for ADUs with a kitchen), allow second kitchens without a special-use permit, and permit attached ADUs provided there is no interior access to the primary residence. "This just reduces some of the previous barriers that may have stopped somebody from looking for an accessory dwelling unit with a kitchen," Loenstein said.
Committee members asked whether other jurisdictions had already implemented AB 396 and whether ADU counts rose there; staff said it’s too soon for clear data. Members also asked how the change affects existing unpermitted ADUs. Loenstein said unpermitted work still requires building permits and must meet setbacks; where setbacks are not met, owners may still need a variance, but eliminating the special-use permit requirement for second kitchens lowers barriers for bringing units into compliance.
A member asked whether multiple accessory structures (sheds) could be converted; staff said ADUs require habitable space and zoning and building standards remain applicable. The committee moved to approve the item and the motion carried; the ordinance will be eligible for adoption at the city council meeting referenced by staff.
