The Fulshear City Council voted to recess into a closed executive session to consult with legal counsel about zoning and related jurisdictional issues, then reconvened and reported no public action.
A council member moved "we move into executive session in accordance with section 551.071 of the Texas Open Meetings Act" to consult with counsel about zoning of the Waters PUD, land-boundary and municipal-authority questions tied to a Heritage development (including municipal utility districts and extraterritorial-jurisdiction and annexation matters), and consultation regarding the North Fort Bend Water Authority. The motion was seconded and the body recessed to executive session at approximately 5:05 p.m.
The minutes show the council returned from executive session at 6:02 p.m. When asked whether there was any action taken during closed session the council reported, "No action." Shortly thereafter a motion to adjourn the special meeting was made and seconded; members voted in favor and the special meeting was adjourned.
The record shows the council used the exception in Texas Government Code §551.071 for attorney consultation. The transcript records motions and procedural votes to recess and to adjourn, but it does not record any public decision or formal vote taken during the closed session.
