The Town Council on June 15 was told that Pound Hill Realty LLC has withdrawn its petition to amend the zoning ordinance and map to create an industrial special management district over an 89.44-acre parcel off Pine Hill Road.
Attorney Bishian Kavanagh, appearing as counsel for the petitioner, handed the clerk a dated letter stating the application was withdrawn without prejudice and noting the possibility of continued mediation and other legal prerogatives for the applicant. The petition, as described on the record, would have proposed mining, sand-and-gravel extraction, stone cutting, crushing, washing and other material-processing operations in a newly created overlay district.
Councilors acknowledged the letter and removed the petition from the agenda; members of the public spoke later in the meeting seeking clarity about mediation outcomes and next steps. Council staff confirmed the withdrawal was submitted during the meeting and that the overlay petition is no longer active on tonight’s docket.
The withdrawal does not foreclose future filings, the attorney’s letter said, and the petitioner retains legal remedies while mediation proceeds.
