Benton City Council approves revised solid-waste contract after vendor concedes on performance threshold

Council action followed a staff report that the city and the proposed provider, BDI, had reached compromise language on two key contract items. Eric, reading a communication from Mr. Johnson, told the council that “we are able to reduce this number to 15,000,” referring to the monthly performance-fee threshold that could trigger termination rights. He also said the provider agreed to extend the contract’s rate-adjustment termination timeframe from four months to 12 months.
Why it matters: the provisions govern when the city may pursue contract termination for repeated poor performance or for a failed rate adjustment. Council members debated whether to set a fixed dollar threshold, a percentage of accounts, or shorten the consecutive-month requirement. Staff explained the contract also contains an incident penalty of $50 per missed-collection incident (capped at $500 per truck per day), and that those per-incident caps can limit how quickly aggregated penalties reach a termination threshold.
During the discussion councilors suggested alternatives including a 10% threshold by accounts and shortening the consecutive-month window from three months to two as a compromise. Staff said the contract in the packet is near-final but that exhibits (service-area maps, exit-fee details and exact effective start date) remain to be finalized before mayoral signature. The council approved the resolution directing the mayor to execute the agreement in substantially the same form as provided, with staff to return final exhibits for the record.
The council also voted to authorize the mayor to execute a lease for the city’s dropbox facility; staff described the lease terms as standard and reasonable.
Next steps: staff will obtain and circulate final contract exhibits (service-area maps, exact term start date and exit-fee language) and return the final documents for administrative signature as directed by the council. No roll-call vote tallies were recorded in the public discussion; the chair announced the motions carried.
