The W Planning Commission voted to grant a variance allowing side setbacks to be reduced from six feet to five feet in the Moonlight Meadows subdivision, with conditions that exterior walls be constructed of non-combustible materials and that a 90% Bill of Assurance be required for future changes. Eric Richardson of Richardson Engineers said the request was intended to accommodate DR Horton's house designs and that lot sizes would not change despite the setback modification.
Staff and a fire-code reviewer concluded that state fire code permits a five-foot setback if the exterior walls meet non-combustible construction requirements. During the staff review, the applicant agreed to place the non-combustible requirement in the Bill of Assurance; staff sought protection against future changes if ownership structures shift, so the 90% threshold was included as a stronger, more permanent condition.
The commission approved the variance by voice vote with the stated contingencies. The condition will be enforced by the city as part of building-permit issuance and as a variance condition on record.
