Planning commission approves Deerfield South preliminary plat for 19 duplexes, halts permits until stormwater coverage is resolved

The W Planning Commission on Tuesday approved the Deerfield South preliminary plat and site plan for a 19-duplex development, but the commission conditioned the approval on the project meeting required stormwater and erosion-control coverage before any building permits are issued. BJ Weathers, the project developer, told the commission the layout and zoning had been approved earlier by the Planning Commission and that the proposal meets the city's zoning requirements. "I'm BJ weathers uh developer of the project," he told the panel, adding that the development would include amenities and a gated entrance intended to limit access from the existing Deerfield neighborhood.

The decision followed public comment from a nearby resident, Terry, who said she appreciated the plans but worried about long-term impacts on property values and neighborhood character if rental duplexes replace single-family homes. "My only concern is as a homeowner in this place is even with a gated community people still walk out they do things," she said.

Staff and the commission discussed an expired automatic-coverage stormwater permit and whether Deerfield South constitutes part of a larger common plan of development that would require a full stormwater plan to be submitted to ADQ. City staff advised commissioners that if the development qualifies as "5 acres or less," the developer could use automatic coverage after transferring or renewing the permit; otherwise they would need to file a full SWPPP for ADQ review. The chair summarized the commission's position: the plat is approved, but no building permits will be issued until the city verifies appropriate ADQ/DEQ coverage and erosion control standards are met.

The approval was made by voice vote on a motion to accept the preliminary plat with the contingency that building permits not be issued until ADQ/DEQ requirements are satisfied. The meeting record shows the motion passed with no recorded opposition. The commission and staff said they will monitor ADQ responses and verify coverage before permits are released.

What happens next: staff will follow up with the developer and ADQ to confirm whether automatic coverage can be renewed for Deerfield South or whether a SWPPP must be filed; construction cannot begin until the required coverage and city inspections are in place.
