Mount Kisco board approves zoning text change to allow veterinary clinics in GR district

On Aug. 5, 2024 the Mount Kisco Village Board adopted Local Law No. 2024-01 to amend the GR General Retail zoning district to permit veterinary clinics and hospitals, following public comment, a SEQRA negative declaration and a roll call in which Trustee Karen B. Schleimer recused.
The Mount Kisco Village Board voted Aug. 5 to amend the village zoning code to allow veterinary clinics and hospitals in the GR General Retail district, clearing the way for a petitioner to pursue planning and site-review approvals.
Mayor J. Michael Cindrich opened a noticed public hearing on the proposal, saying the amendment "has been before the Board since November of 2023" and that the change would permit veterinary hospitals in the district. Charles Martabano, attorney for petitioner Crossroads Plaza, asked the Board to adopt the text amendment so his client could proceed with Planning and Zoning reviews.
Conservation Advisory Council Chair John Rhodes told the Board the CAC had no consensus to support a blanket allowance across the entire district and recommended allowing the use only by special permit or limiting it to particular sites because much of the district abuts the Kisco River and other natural resources. Trustee Karen B. Schleimer stated she was asked to recuse because of the proximity of her residence to the application and respected that request. Deputy Mayor Theresa Flora said she visited the site, lives nearby, and supported the proposal, calling the prospective business "a good steward to the Village." A nearby resident, George Arco, told the Board he supported the text change and had not experienced problems with the existing operation.
After closing public comment, the Board adopted a negative declaration under the State Environmental Quality Review Act and passed a resolution adopting Local Law No. 2024-1 to amend Chapter 110 (Zoning) to permit "Veterinary Clinics and Hospitals" in the GR district. The motions to close the hearing and to adopt the SEQRA finding and the local law passed in roll-call votes; Trustee Schleimer recused from those votes.
The petitioner may now proceed to the Planning and Zoning Boards for site review and any required special permits. The local law takes effect as provided in the ordinance filing requirements.
