The Craiger Planning Commission granted a variance Aug. 8 allowing an existing board-on-board fence at 3550 Heritage Parkway to remain despite standard front-yard height restrictions.
Staff told the commission the fence was constructed without a permit by the fence contractor, not the property owner, and that the lot’s distance from the highway gave adequate sight lines for driveway access. The fence owner submitted a neighbor letter of support and the commission considered the variance procedure appropriate for this case because the fence does not appear to create the typical sight-line or driveway-safety hardships the ordinance seeks to prevent.
Commissioners noted that variance procedures are intended for property-specific hardships and concluded the fence presented such a circumstance given the commercial parking layout and long setback to the highway. The motion to approve the variance passed by voice vote, meaning the property owner will not be required to remove the existing fence.
