Planning commission backs recommendation to rezone highway parcel back to A1 after misinformation flagged

The Craiger Planning Commission on Aug. 8 recommended that city council rezone a highway-front parcel from mixed-use back to A1, a single-family residential district, after a lengthy discussion about future use and tax implications.

The commission’s Chair opened the item and staff reported that the city attorney had concluded there is no mechanism to permanently protect the owner’s intended future use under the current code; property tax assessments, staff said, are based on actual use rather than zoning. Commissioners debated whether a recommendation to rezone would create a problematic precedent but also acknowledged the owner had been given incorrect guidance by a city official. One commissioner said the change was being considered “because they were given wrong information by someone who had a city address.”

Commissioners discussed practical outcomes: under A1 the lot would remain a nonconforming use while the current use continues, and a future buyer would not automatically be able to develop it for commercial purposes without a rezoning petition. Staff noted the new zoning code’s rules about resubmittals — if a rezoning request fails there is typically a waiting period before it can be refiled — and that utilities and development on the opposite side of the highway could still direct future change.

After discussion, a commissioner moved and the commission voted to recommend rezoning the parcel back to A1 and forward that recommendation to the city council. The council will consider the matter in its upcoming docket.

The commission did not adopt any additional protections beyond the zoning recommendation; the item will next be heard by Craiger City Council.
