Painesville City Council on May 18 adopted an ordinance amending Section 167.30 of the Codified Ordinances to align overtime for non‑union, non‑exempt employees with the Fair Labor Standards Act.
City Manager Doug Lewis told Council the change removes the local daily‑overtime trigger (overtime after eight hours in a day) and instead treats overtime for covered employees as hours worked over 40 in a work week, consistent with federal law. "This change creates consistency with the federal standard and simplifies overtime administration and payroll practices for non‑exempt and non‑union employees," Mr. Lewis said. He added staff does not expect a significant fiscal impact and suggested the change could reduce overall overtime costs by allowing schedule flexibility across the work week.
Council suspended the rules and adopted the ordinance on first reading by roll‑call vote; the minutes note council discussion confirming that union employees remain subject to the terms of their collective‑bargaining agreements, which may still include daily overtime provisions.
Next steps: the ordinance (recorded in the minutes as ORDINANCE 13‑26) takes effect per the charter/ordinance rules and city payroll and human‑resources staff will update administrative procedures to reflect the standard.
