The Davison County Board of Adjustment on June 10, 2025, approved a conditional-use permit allowing Melvin Fisher to sell construction equipment, with a condition barring consignment, for property described as Tract A of Spruce Acres in the southeast quarter of Section 35, T103N, R60W.
Board member Nebelsick moved to grant the conditional use under Section 12:06(A) and 4:04(5) of the Davison County Zoning Ordinance; board member Kiner seconded. The board voted unanimously in roll call: John Claggett, Randy Reider, Blaalid, Kiner and Nebelsick all voted aye, approving the request.
The Planning Commission had recommended approval by a 5-0-2 vote. Meeting materials recorded that the application was received May 19, 2025; notice of the request was published in the Daily Republic on May 24 and May 31, 2025; signs were posted May 23, and the applicant and abutting property owners were notified on May 22. Chairperson Randy Reider opened the public-input period for items not on the agenda; no members of the public spoke on the application at the meeting.
The conditional-use motion, as recorded in the meeting minutes, specifies the sale of construction equipment in the Agricultural Residential District with no consignment. Deputy Auditor Christine Norwick attested to the minutes. The board adjourned at 10:07 a.m.
Next steps: the minutes and the recorded action serve as the official grant of the conditional use; the transcript and published notices document that public notice requirements were met. The record does not show any additional conditions beyond the “no consignment” restriction, nor does it record any amendments to the motion.
