Davison County Board of Adjustment approves three conditional uses including mining extraction

Chairperson Randy Reider opened the meeting at 9:15 a.m. and said all board members, the Planning and Zoning Deputy Administrator and Auditor Kathy Wingert were present. After approving the meeting agenda and the April 8 minutes by unanimous voice vote, Reider called for public input and reminded attendees that remarks should be limited to items not on the agenda; no public comments were offered.
The board first considered a conditional use requested by Commercial Asphalt to allow extraction of sand, gravel or minerals as a surface-mining operation in the Agricultural District. The request was made under Davison County Zoning Ordinance 3:04(14) and cited state surface-mining provisions in SDCL 45-6B. The Planning Commission had recommended approval by a 6-0-1 vote. Board member Nebelsick moved to grant the conditional use, Claggett seconded, and a roll-call vote recorded Claggett, Reider, Blaalid, Kiner and Nebelsick as voting aye; the motion carried.
Next, the board granted a conditional use for Melvin Fisher and Joshua Staub to operate an auto-sales business limited to a maximum of five vehicles in the Agricultural Residential District (Tract A of Spruce Acres, SE¼ Section 35, T103N, R60W). The Planning Commission recommended approval (6-0-1) but noted that trailers and construction equipment on the property should be readdressed at the Planning Commission level. Nebelsick moved to approve the conditional use; Claggett seconded. The roll-call vote was unanimous in favor.
The final conditional use approved was for Tanner Cross to operate a boarding stable and fencing company in the Agricultural District (Lot D of Kotrba’s Subdivision in SW¼ Section 15, T103N, R61W). That request — under Davison County Zoning Ordinance 3:05 — also carried a Planning Commission recommendation of 6-0-1. Blaalid moved to grant the conditional use, Nebelsick seconded, and the board approved the motion with all members voting aye.
The board adjourned at 9:34 a.m. on a unanimous vote after completing the listed business. The meeting record includes attestation lines naming Kathy Wingert as auditor and Randy Reider as chairperson; one attestation entry in the published record appears garbled and is noted in meeting records. The board did not take other formal action during the meeting.
