Planning commission recommends approval for Commercial Asphalt mining permit in Davison County

The Davison County Planning Commission on May 6 recommended that the Board of Adjustment approve a conditional‑use permit for Commercial Asphalt to extract sand, gravel or minerals under SDCL 45‑6B on land in the SW1/4 of Section 33.

Deputy Director of Planning & Zoning Karen Wegleitner presented the application and said the company and the landowner answered the commission’s outstanding questions. Neil Waldera, representing Commercial Asphalt, and landowner George Ryks told the commission the site is not enrolled in the Conservation Reserve Program, trucks will use 408th under a county road‑haul agreement, and daily truck counts will vary — “there will be days with 3–5 trucks and days with no hauling,” according to the minutes. The applicants did not provide a fixed timeframe for when surface mining would end.

Commissioners focused on access, haul route and CRP status before moving to a recommendation. Commissioner Lewis Bainbridge moved and Commissioner Steve Thiesse seconded a motion to recommend approval with no conditions; the motion carried on a roll call vote with all members present voting aye except the two absentees recorded in the minutes. The minutes state, “All members voted aye, the motion carried.”

The commission’s recommendation will go to the Board of Adjustment for final action. The minutes note the applicant obtained a county road‑haul agreement for 408th; any future operational limits or monitoring, and a formal permit decision, will be determined by the Board of Adjustment and any applicable county permitting processes.
