Davison County Board of Adjustment unanimously approves two variances and a conditional use

The Davison County Board of Adjustment met March 11, 2025, and unanimously approved two variances and a conditional-use permit during a short session that began at 9:15 a.m. and adjourned at 9:27 a.m. Chairperson Randy Reider presided; all board members were present and Planning and Zoning Deputy Administrator Wegleitner and Auditor Kathy Wingert attended.
The board granted a variance for Bradley James after consideration of Section 12:06(B) of the Davison County Zoning Ordinance. The approved request reduces the front-yard setback by approximately 32 feet, creating a proposed setback of about 43 feet from the east property line for a proposed house addition where the minimum front-yard setback in the Agricultural Residential District is 75 feet. The application was received Dec. 12, 2024; public notices ran in the Daily Republic on Feb. 22 and March 1, 2025; a sign was posted Feb. 21; and affected parties were notified Feb. 18. The motion to grant the variance was moved by Nebelsick, seconded by Kiner, and carried on a roll call vote of Claggett-aye, Reider-aye, Blaalid-aye, Kiner-aye, Nebelsick-aye.
The board also approved a conditional use for Jeff Nicholson to operate auto sales and vehicles, including trailers, in the Agricultural District pursuant to Section 3:04(5) of the Davison County Zoning Ordinance. The Planning Commission recommended approval 6-0 with one absence. The motion was moved by Claggett, seconded by Nebelsick, and passed on a unanimous roll call vote.
Finally, the board granted a variance requested by PZ Partnership to reduce a parcel by about 19 acres, creating a proposed lot of approximately 6 acres where the minimum lot size for a residence in the Agricultural District is 25 acres, under Section 3:07(4). The property will be legally described as Lot 1A, a subdivision of Lot 1 of Feterl Addition, if recorded. The Planning Commission recommended approval 6-0 with one absence; the board approved the variance on a roll call vote of all members voting aye.
The meeting handled routine procedural business earlier in the session, including approval of the agenda and the Jan. 14, 2025 meeting minutes. Chairperson Reider called for public input on non-agenda items and reported that none was offered. The board adjourned at 9:27 a.m.
