The Washington Terrace City Council on June 16 approved a development agreement for an infill project at 445 West 5100 South that reflects a recent change in ownership of a narrow strip of land and preserves access for an existing adjacent resident.
Tom, speaking for city staff, explained the ownership switch and the required change to the development agreement. "The developer shall preserve a perpetual nonexclusive access easement benefiting the existing resident located on parcel number 07-0660028," Tom said, describing the easement as providing vehicular and pedestrian access, running with the land, and to be recorded with the Weber County Recorder.
Tom and councilmembers said the change concerns ownership and an easement only and does not change land use. A representative named Matt was present to answer questions about the conveyance; the council expressed that the item was straightforward. A motion to approve Motion/Ordinance 26-03 was made and seconded; the council voted unanimously to approve the development agreement.
The staff presentation noted the easement will be recorded at the Weber County Recorder's office and a copy provided to the city. The agenda item was brought back to council after the ownership and conveyance details were finalized prior to closing.
Next steps: staff will record the easement and provide the recorded copy to the city as required by the agreement.
