Lancaster council votes to settle Delta Victor LLC lawsuit under proposed Rule 11 terms

Following a closed executive session on Sept. 15, Lancaster’s city council reconvened and voted to accept proposed settlement terms in the lawsuit Delta Victor LLC v. City of Lancaster, Cause No. DC23‑O9494, pending in the 68th District Court of Dallas County.
City Attorney/Litigation Counsel (speaker 10) summarized the motion coming out of executive session and said the action would follow the proposed Sept. 8 Rule 11 agreement. A council member (speaker 6) moved to settle and the mayor (speaker 1) seconded; the mayor called the vote and the motion carried. "Based on that, your litigation council will prepare the settlement documents and I will review the real estate transaction portion and we'll get that back to you wrapped up," the city attorney said.
The council did not disclose the settlement dollar terms or detailed conditions during open session; the attorney said staff and litigation counsel would prepare the documents for forthcoming review. No vote tally by name was read into the record during open session; the mayor stated simply that the motion carried.
Next steps: litigation counsel will draft settlement and accompanying real‑estate transaction documents and return them to council for formalization and any required approvals.
