The Batesville Planning Commission voted to approve draft revisions to the city’s zoning code (chapters 14.05, 14.07, 14.08, 14.13, 14.20 and 14.28) and amended the draft to add public and private nonprofit schools as a permitted use in the T1 zoning district.
Commission members discussed whether schools were already allowed under existing commercial or residential provisions and whether any permission should be limited to T1. After debate the commission amended the draft ordinance to permit public and private nonprofit schools in T1 and then approved the revised package. One commissioner was recorded as opposed to the final vote.
The amendment is intended to clarify where schools may locate and reduce uncertainty for applicants and neighborhood residents. Commission discussion focused on whether commercial zoning should also permit schools or whether the permission should be limited to the T1 classification; the commission chose the latter in the motion it adopted.
Staff characterized the vote as consistent with prior discussion of the draft and recommended approving the revisions as amended. The commission closed the public hearing on the draft before taking the motion.
