Logansport BZA approves homeowner’s variance to replace wind-damaged shed with condition it not exceed original footprint

The Logansport Board of Zoning Appeals on Wednesday voted to approve a petition allowing a homeowner to replace a wind-damaged shed, provided the new structure does not exceed the footprint of the original building and that all applicable permits and any required fire-separation measures are obtained.
Planning staff told the board the original shed had stood for many years as a legal nonconforming structure but was destroyed in spring windstorms; because the structure no longer exists, any replacement must meet current standards. Staff said the petitioner seeks to replace the shed in the same general location behind the house, proposing a structure approximately 10 by 12 feet that would sit about 1 foot from the south property line and within 1 foot of the primary dwelling, requiring a variance from the R2 side-yard setback (7 feet required) and the 10-foot accessory-to-primary structure separation rule.
The petitioner, Harold Edwin Price of 2525 Stadium Drive, told the board he had not yet bought a replacement unit because he was waiting on the variance. "I haven't decided what to put back up because I didn't know if I was going to get a variance or not," Price said. He agreed on the record that any replacement would be the same size or smaller than the prior shed; staff’s conditions of approval recorded that commitment and required the petitioner to obtain any state and local permits and provide proof to the zoning administrator.
Staff also advised that depending on what the owner stores in the replacement shed, a fire separation wall would be required; the board asked the petitioner to coordinate with the building commissioner on any fire-rating requirements. No members of the public offered testimony in the case.
A motion to bring BZA case 26-04 to a vote was made, seconded and carried. The board approved the petition with the stated conditions; the zoning administrator will send a written notice of the decision. The board’s roll-call recorded unanimous approval.
The decision may be appealed to the circuit court within 30 days of the meeting.
