Russellville finance committee keeps title search open for strip west of 417 East Street

At the Sept. 18, 2025 meeting of the Russellville City finance committee, members debated ownership of a narrow strip of land immediately west of 417 East Street and agreed to keep the matter on the committee agenda while staff completes a title search.

Committee members said the records include inconsistent parcel descriptions that have made the title search difficult. One council member summarized the problem as a set of “strips of land that don’t have anyone owning it,” and noted the assessor’s office had previously flagged similar gaps in adjacent neighborhoods. City staff said the search was underway but not yet returned. Mr. Smith told the committee he had been contacted by the person handling the search and hoped to have findings early next week.

Members discussed possible outcomes: the parcel could show ownership by one person, multiple adjacent owners or heirs, or evidence of a city right-of-way or easement. Council members said a quiet-title action or other legal steps might be necessary depending on the search results, and they emphasized the need to avoid acting until the legal status is clear.

Because the resident who brought the issue to the committee remains affected, a council member moved to keep the item on future finance agendas until it is resolved; the motion was seconded and approved. Committee members also said they would be prepared to convene a special called meeting if the title search reveals an issue that requires formal council action.

Next steps: staff will complete the title search and report back; if the search indicates that council action is required, the finance committee or the full council will consider next steps at a future meeting or a special session.
