Alderman Joe Piper asks Musson Brothers to explain delayed work on Magnolia, Hein and Comanche

The Dean Board of Public Works approved the night’s payments on December 19 but members pressed staff to bring Musson Brothers before the board to explain delays and unfinished work on Magnolia, Hein and Comanche.
Alderman Joe Piper moved the payments and used his opportunity to ask for a contractor presentation. “I would like that in the case of Musson Brothers to have someone from their company come in and give the board an explanation as to what happened this year,” Piper said, adding he had received calls and emails from residents about the Magnolia project and wanted the public to hear the contractor’s account.
Staff told the board that not all of the work is complete and that the temporary paving placed on Hein was done late in the season. “That’s we're considering that a temporary pavement because it was placed too late in the season on frozen ground,” staff said, and added: “So we're not accepting that pavement.”
Staff also noted the city has, in prior cases where contractors failed to complete work on time, charged liquidated damages under contract terms. “We have in the past had times where contractors don't get jobs done and we follow and push them,” staff said. “We've in the past, numerous occasions, charged liquidated damages according to the contract requirements.”
Board members asked staff to arrange for Musson Brothers to appear at a January meeting so the company can explain schedule slips and remaining work. The payments motion then passed on a unanimous vote.
