The council approved an ordinance and a separate lot-split resolution designed to resolve surveyed boundary and lot-depth problems affecting several multi-family structures and to allow lender financing for a pending sale.
Logan Ho, representing 9d Properties, explained that a fourplex and two duplexes had become functionally uninhabitable under prior ownership; two properties had been acquired by 9d Properties LLC after a bank foreclosure and one duplex is under contract to Neil Riley. An appraiser identified a boundary encroachment: narrow 10-foot strips and lot depths that, under R2 zoning, left the duplex short of the 100-foot minimum depth required for that district.
Ho said the requested actions were (1) a rezoning from R2 to R1 (R1 has a 90-foot minimum lot depth), and (2) lot splits to adjust boundaries and remove the encroachment so two of three structures would be conforming. He told the council the change is contiguous with existing R1 zoning and is not spot zoning.
The council introduced Ordinance No. 1450 to amend the zoning map, suspended three readings and voted for final passage; it separately approved the lot-split resolution for 9d Properties LLC. The action is intended to allow the lender's appraiser to mark the duplex as a conforming, highest-and-best use so financing can proceed for the purchaser, Neil Riley.
