Council advances deanexation process for ~28.5 acres, schedules final hearing July 20

The Newberg City Council voted June 15 to advance a property-owner-initiated deanexation (withdrawal) process for about 28.5 acres and fixed a final hearing date.
Scott Sele, community development director, told council Delboka Vista LLC requested the withdrawal of territory that had been annexed in 2006 and is mostly in the R2 Riverfront District and within a special flood hazard area and stream corridor overlay. "The area is difficult to serve and has low urban development capacity," Sele said, adding that staff had referred the application to the county and confirmed there is no outstanding city debt for those lots.
Under the state statute OS 222.460, the council first adopted a resolution to initiate the withdrawal process (Resolution 2026-432), opened the public hearing and, having received no public testimony, entered Order 2026-000047 to set a final hearing no earlier than 20 days and no later than 50 days from the order. The council noted potential next steps under Senate Bill 1537 that would allow an equal-area land-swap into the urban growth boundary if the council later chose to remove the land from the urban growth boundary.
Council members asked for clarifications about the land-swap option, Measure 37/Measure 49 history and how the removal would affect the city’s land inventory. Staff said that if the council approves removal from the urban growth boundary later, the city could pursue either the SB 1537 land-swap route or the one-time urban growth boundary expansion process; the two paths are mutually exclusive once chosen.
The council voted to adopt the initiating resolution and then adopted Order 2026-000047; the final public hearing on a detachment ordinance is scheduled for July 20, 2026. Staff recommended asking the applicant to sign non-remonstrance and Measure 49 waiver documents to resolve potential future claims if the withdrawal proceeds.
Council’s order recorded the procedural steps required by state law and directs staff to return with final ordinance materials and any necessary NURA (urban renewal) board action as the process continues.
